ORDER

This petition has been filed to modify the condition in para 5(b), imposed on the petitioner in Crl.O.P.No.31938 of 2024, dated 20.12.2024, that the petitioner, without prejudice to his rights and contentions before the Trial Court, is directed to deposit the original title deeds of an immovable property not less than the value of Rs.15 lakhs (standing in the name of the petitioner or his relatives or his friends) to the credit of Crime No.265 of 2024 before the Court concerned, at the time of furnishing sureties. 1/4

Learned counsel appearing for the petitioner submits that this Court vide an order dated 20.12.2024 granted bail to the petitioner with one of the condition of depositing original title deeds of an immovable property standing in his name or his relatives or his friends worth about Rs.15,00,000/-. He further submitted that the petitioner owns a flat, which has been purchased by availing housing loan and the said loan is still in force, thereby, the original document of the said flat has been deposited with the bank towards security for due repayment. He also submitted that the friends and relatives of the petitioner are hesitant to furnish the original documents of their immovable properties worth about Rs.

15 lakhs, due to which, the petitioner could not able to comply with the condition imposed on him and therefore, he could not able to come out in bail, despite of granting bail by this Court vide an order dated 20.12.2024. He also submitted that the petitioner's brother has come forward to offer original title deed of his property worth about Rs.1,80,000/- to the credit of Crime No.265 of 2024, as per the direction of this Court. He further submitted that the petitioner has been arrested and in custody from 05.11.2024 and for more than 78 days, even after grant of bail by this Court, therefore, he prayed to modify the condition in para 5(b), imposed on the petitioner in Crl.O.P.No.31938 of 2024, dated 20.12.2024.

Learned Government Advocate (Crl.Side) submitted that the petitioner, by making a false promise, induced the defacto complainant and made her to invest a sum of Rs.10,27,06,364/- in shares, further, obtained a sum of Rs.14 lakhs from the defacto complainant and cheated her. He also submitted that major part of the investigation has been completed. 2/4

Considering the submissions of both sides and the fact that the major part of the investigation has been completed, the condition in para 5(b), imposed on the petitioner in Crl.O.P.No.31938 of 2024, dated 20.12.2024, is modified to the effect that the petitioner, without prejudice to his rights and contentions before the Trial Court, is directed to deposit the original title deeds of an immovable property worth about Rs.1,80,000/- (which stands in the name of the petitioner or his relatives or his friends) to the credit of Crime No.265 of 2024 before the Court concerned, as surety. 5.
