ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, was arrested on 24.02.2017 and remanded to judicial custody for the alleged offences punishable under Section 302 of I.P.C. in Crime No.172 of 2017 on the file of the respondent police and hence, seeks bail.
2. The case of the prosecution is that after the betrothal function of Sangeetha, the first accused on 22.01.2017, with other accused having known the love affair of the deceased with the Sangeetha, murdered him at 6.00 p.m. on 22.01.2017.
3. The learned counsel appearing for the petitioner submits that the petitioner has been in custody from 24.02.2017; that he is innocent of the offences; that there is no overtact against the petitioner and that the petitioner is having permanent residence and therefore, he may be released on bail.
4. Learned Government Advocate [Crl. Side] opposes this petition contending that there are other two accused who have been detained under Act 14 of 1982 and that the petitioner caught hold of the deceased while the co-accused were attacking the deceased and investigation is not yet over.
5.Considering the duration of custody and the overtact attributed against the petitioner and also the fact that the petitioner is having a permanent residence and also the facts and circumstances of
the case, this Court is inclined to enlarge the petitioner on bail with certain conditions.
6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for Rs.10,000/- [Rupees Ten Thousand only] with two sureties each for a like sum, to the satisfaction of the learned Judicial Magistrate, Ponneri and on further condition that the petitioner shall report before the respondent police on every Monday at 10.00 a.m., for a period of two months. -sd/- 05/05/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
