J U D G M E N T

This Court passed an order on 14.07.2009, ordering notice to the respondents. The appellant has not paid batta nor served notice to the respondents privately. Again, an opportunity was granted by this Court on 30.01.2019, permitting the appellant to serve notice to the respondents. Private notice was also permitted. In spite of the opportunities, the appellant has not taken any steps to serve notice to the respondents.

The learned counsel appearing for the appellant made a submission that they have also taken steps to secure further instructions regarding the correct address of the respondents and they are unable to get instructions for the purpose of serving notice to the respondents.

This being the factum, the appeal cannot be kept pending for an unspecified period. Accordingly, CMSA.No.20 of 2009 stands dismissed. No costs.
