O R D E R

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 6(4) of the Tamilnadu Scheduled Commodities (RDCS) Order 1982 7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.120 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in possession of 1800 kgs of PDS illegally. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not indulged any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the State submitted that the petitioner was found in possession of 1800 kgs of PDS illegally. He further submitted that the petitioner is a habitual offender.

5. Considering the nature of the offence committed by the petitioner and taking note of the fact that the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
