This petition has been filed seeking to condone the delay of 301 days in representing the above said Civil Revision Petition in C.R.P.SR.No.117599 of 2021 before this court.
2. Mr.Thomas T.Jacob, learned counsel for petitioners submitted that the above petition was returned for compliance of certain defects. However, the 1st petitioner was suffered from Covid and thereafter he landed up with post covid complications and facing prolonged sickness, due to which, he was not able to approach his counsel to prefer this petition. However, due to lack of communication to the counsel, he was not able to represent the petition in time. Hence, there is a delay of 301 days arose in representing the above Civil Revision Petition and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.
3. Considering the facts and circumstances, and the reasons stated by the petitioners in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order. 20.03.2023 rpp https://www.mhc.tn.gov.in/judis
