ORDER

(This case has been heard through video conference) This Criminal Original Petition has been filed seeking a direction to conduct speedy trial of the case in Spl.C.C.No.01 of 2015 pending on the file of learned Chief Judicial Magistrate, Dharmapuri.

2. Mr. C. Palanisamy, learned counsel appearing for petitioner would submit that, the criminal case is of the year 2015, and even though the trial has commenced and almost all the witnesses are examined, the case is still pending. In the said circumstances, this petition has been filed to conduct speedy trial.

3. The learned Government Advocate (Criminal Side) appearing for respondent, on instructions, would submit that, now the trial has commenced and out of 21 witnesses, 18 witnesses were https://hcservices.ecourts.gov.in/hcservices/

examined and due to Covid-19 pandemic, now the physical hearing in the courts have been closed. Hence, the trial court could not proceed with the trial.

4. Heard and considered rival submissions made by learned counsel appearing for both sides and perused the records.

5. Considering the fact that, the trial is almost completed, only three more witnesses have to be examined, the Trial Court is directed to proceed with the trial and dispose of the same within a period of three months from the date of reopening of courts for physical hearing. Accordingly, this Criminal Original Petition is disposed of.
