Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the order dated 30.12.2024 passed by the 3rd respondent in Na.Ka.No.A5/1155/2023 and quash the same and consequentially to direct the 3rd respondent to remove the 4th respondent from the post of President of Genganallur Village Panchayat, Anaicut Taluk, Vellore District within the time frame to be fixed by this Hon'ble Court.

O R D E R

The Writ Petition has been filed in the nature of a Certiorarified Mandamus seeking records relating to an order dated 30.12.2024 passed by the 3rd respondent, District Collector/Inspector of Panchayats at Vellore in Naka No.A5/115/2023 and quash the same and direct the said 3rd respondent to remove the 4th respondent from the post of President of Genganallur Village Panchayat at Anaikut Taluk in Vellore District. 2.In the affidavit filed in support of the writ petition, it is stated that the petitioner is a resident of Genganallur Village Panchayat at Anaicut Taluk in 2 / 6

Vellore District and a supporter of various welfare schemes floated by the State and Central Government for uplifting the marginalised Section of people. The 4th respondent was elected as the President of the Panchayat. The petitioner has deep grievances against the manner of functioning of the 4th respondent in discharge of duty as President of the Village Panchayat. 3.The petitioner had earlier filed WP.No.27600 of 2023 in the nature of a Mandamus seeking a direction against the 3rd respondent, the District Collector of Vellore to consider representations dated 20.02.2023 and 28.07.2023. The petitioner alleged that the 4th respondent had misappropriated funds of the Panchayat and had not utilised them for the purpose for which they were allocated. The petitioner also filed WP.No.

19234 of 2024 again in the nature of a Mandamus seeking examination of another representation dated 31.05.2024 seeking to remove the 4th respondent from the post of President. 4.It had been stated that the 3rd respondent had passed orders which is now impugned in the writ petition. The petitioner has grievance against the said order. 5.

of the Village Panchayat. G.O.Ms.No.1 of 2025 had been passed on 06.01.2025 abolishing all the Panchayats and placing the Block Development Officer incharge. Therefore, the relief sought by the petitioner cannot be granted. But however the petitioner can now give a fresh representation to the Block Development Officer who is now incharge of the Village Panchayat and seek examination of the accounts or other aspects relating to the functioning of the Panchayat. This would be independent of the earlier representations and should be considered in the manner known to law. The impugned order is not interfered with but liberty is granted to the petitioner. 6.The Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
