ORDER : The Court Made the following order :- Petitioners who are arrayed as A-1, A-2 and A-3, were arrested on 14.03.2017 in Crime No.272 of 2017 for the alleged offences punishable under Sections 174(iii) of Cr.P.C. @ 498(A) r/w 304(B) of IPC, on the file of respondent police, seek bail.
2. The case of the prosecution is that the petitioners and other accused have harassed the deceased and also ill treated her by demanding dowry. The deceased committed suicide. Hence, a case has been registered.
3. The learned counsel for the petitioners would submit that the 1st petitioner is the husband and the second petitioner is the mother-in-law and third petitioner is the sister-in-law of the deceased and absolutely a false case had been foisted against them and they are in custody for more than a month. Hence, he seeks to enlarge them on bail.
4. The learned Government Advocate (Crl.Side) would submit that there are totally 9 accused in this case and these petitioners are A-1 to A-3 and RDO reported is awaited.
5. Admittedly, the petitioners are in custody from 14.03.2017, investigation of the matter has also been completed and only RDO report is awaited in this case. In such circumstances, this court is of the view that there is no need of further incarceration of the petitioners 2 and 3 since they were in-laws and hence, deems it fit to enlarge the petitioners 2 & 3 on bail on the following conditions. Accordingly, it is ordered that the petitioners 2 & 3 shall be released on bail, on executing a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate-II, Poonamallee, and shall report before the respondent police daily at 10 a.m., for a period of two weeks and thereafter as and when required for interrogation.
