The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(4) and 344 of BNS, 2023, in Crime No.188 of 2025 on the file of the respondent Police, seeks 1/4

anticipatory bail.

The earlier criminal original petition in Crl.O.P.No.34454 of 2025 seeking anticipatory bail has been disposed of by this Court by an order dated 16.12.2025 on the following reasons: "6.I have also gone through the statements and other connected materials, and it revealed that the petitioner has collected a huge amount from A1, and so far, no amount has been recovered. Hence, if the petitioner is granted anticipatory bail, he will indulge in similar kinds of offence. This Court is not inclined to grant anticipatory bail to the petitioner."

The learned counsel appearing for the petitioner submitted that subsequent to the dismissal of the earlier bail application, one of the coaccused was granted bail in Crl.O.P.No.35411 of 2025 vide order dated 30.12.2025 and hence, seeks anticipatory bail. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that still the case is under investigation. 4.

Heard the submissions made on both sides and perused the materials available on record.

I have also gone through the order in Crl.O.P.No.35411 of 2025 dated 30.12.2025, in which, it is stated that the co-accused property worth about Rs.85 lakhs were seized on that ground, bail was granted. This very ground is not applicable to the petitioner herein since there is a specific allegation that Rs.96 lakhs has been swindled by the petitioner. Considering the above facts and circumstances of this case, gravity of offence, the fact that there is no change in the circumstances, this Court is not inclined to revisit the earlier order.
