O R D E R

This petition has been filed seeking to call for the records and to quash the proceedings as against the petitioner/ A-3, pending in Cr.No.1 of 2014 on the file of the Inspector of Police, CCIW CID, Krishnagiri, Krishnagiri District.

2.The learned counsel appearing for the petitioner would submit that the petitioner was appointed as Clerk in the second respondent society. While he was discharging his duties as clerk in the said society on deputation basis, the petitioner was transferred to another society on 01.01.2020 and relived on 31.12.2012, once again transferred to the second respondent's society on 01.01.2012 and transferred to Chinnakuthur PACCS on deputation basis. When the petitioner ordered for enquiry and passed surcharge order against the petitioner, the defacto complainant/second respondent herein https://hcservices.ecourts.gov.in/hcservices/

deleted the name of the petitoner from all proceedings and pass orders, after findingout that the petitioner has not committed anything. Hence the FIR registered against the petitioner.

3.The learned counsel appearing for the petitioner would further submit that, it would suffice, if this Court permits the petitioner to furnish the particulars before the law enforcing agency to prove his innocence and issue direction to the law enforcing agency to complete the investigation within a time frame.

4.The learned Additional Public Prosecutor concedes to the request made by the learned counsel appearing for the petitioner and on instructions, he would further submit that the investigation will be completed within the time frame fixed by this Court.

5.Considering the limited request made by the learned counsel appearing for the petitioner, this Court without going into the merits of the case, is inclined to issue direction to the law enforcing agency to complete the investigation in Crime No.1 of 2014, after giving opportunity to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to co-operate with the law enforcing agency for early completion of the investigation.This criminal original petition is disposed of.
