ORDER

The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 420, 224 of IPC in Crime No.647 of 2018 seeks anticipatory bail.

2. The allegation against the petitioner is that on 12.01.2018, the petitioner fraudulently obtained bail on 04.10.2018 by concealing the cases that

were pending against him and thereby unlawfully escaped from the judicial custody. Hence, the case.

The learned counsel for the petitioner submitted that the petitioner has been regularly appearing in all cases registered against him and that, even after a lapse of seven months, he appeared before the learned V-Metropolitan Magistrate, Egmore in connection with C.C.No.8447 of 2019. It is further submitted that, all of a sudden, the petitioner was searched by the respondent police in the present case. The learned counsel would submit that the case itself was registered in the year 2018 and that the petitioner is ready and willing to cooperate with the investigation and therefore, prays for grant of anticipatory bail.

The learned Government Advocate (Crl.Side), appearing for the respondent police, reiterated the prosecution's case and submitted that the investigation in the present case has been completed and that the final report has already been filed before the learned Judicial Magistrate, Madhavaram. It is further submitted that the petitioner has multiple cases registered against him and prays for dismissal of the anticipatory bail application filed by the petitioner.

5. Considering the fact that the petitioner has regularly appeared before the Court in various cases and taking into account that the present case pertains to the year 2018, I am inclined to grant anticipatory bail to the petitioner, notwithstanding his involvement in several previous cases.

Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned District Munsif cum Judicial Magistrate, Madhavaram on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b) the petitioner shall report before the learned District Munsif cum Judicial Magistrate, Madhavaram everyday at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation; (c) the petitioner shall not tamper with evidence or witness either during investigation or trial; (d) the petitioner shall not abscond either during

investigation or trial;

(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
