C.M.P.No.10748 of 2022 in C.M.A.SR.No.5663 of 2020 P.T.ASHA, J., This petition is filed to condone the delay of 44 days in filing the C.M.A.
against the judgment and decree passed in M.C.O.P.No.10 of 2018 on 29.08.2019, on the file of the learned Motor Accident Claims Tribunal (Special Subordinate Judge No.II) Salem.
2. Mr.J.Chandran, learned counsel appearing for the petitioner/appellant is dispensing with the presence of the 2nd respondent, who is only the owner of the vehicle. It is seen that the Insurance Company has challenged the award only on the grounds of quantum and negligence.
3. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is allowed.
