ORDER

By consent of both the parties, this writ petition is taken up for final disposal at the time of admission itself.

2. Heard M/s.A.Thendral, learned counsel for the petitioner and Mr.V.Shanmuga Sundar, learned Special Government Pleader for the respondents. Since no adverse orders are passed against the 4th respondent, notice to 4th respondent is dispensed with by this Court.

3. This writ petition has been filed for a Mandamus seeking for a direction to the 3rd respondent to dispose of the petitioner's application, dated 11.10.2019 filed against the 4th respondent under the the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, within a time frame to be fixed by this Court.

4. It is the case of the petitioner that the 4th respondent is her son. According to her, the 4th respondent has not been maintaining her, despite he being provided with sufficient properties. The petitioner submitted an application under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on 11.10.2019 against the 4th respondent. According to the petitioner the said application has not been considered till date. In such circumstances, this writ petition has been filed.

Mr.V.Shanmuga Sundar, learned Special Government Pleader appearing for the respondents 1 to 3, on instructions would submit that enquiry proceedings has already been commenced on the application submitted by the petitioner under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 against the 4th respondent and the next date of enquiry is fixed on 09.02.2021 at 11.00 a.m. He would further submit that within a time frame to be fixed by this Court, the 3rd respondent shall pass final orders on the petitioner's application filed under the aforesaid Act against the 4th respondent.

After recording the submissions made by the learned Special Government Pleader, this Court directs the 3rd respondent to pass final orders on the petitioner's application, dated 11.10.2019 filed against the 4th respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording a fair hearing to the petitioner as well as the 4th respondent on merits and in accordance with law. With the aforesaid direction, this writ petition stands disposed of. No costs.
