Pending appeal suit, the second respondent namely K.P.Murugesan died. Hence these three petitions are taken to condone the delay in filing the petition to set aside the abatement caused due to death of the second respondent, (ii) to set aside the abatement and (iii) to bring on record the legal representatives of the deceased second respondent.
2. The learned counsel appearing for the appellant has no objection in allowing these petitions.
3. Recording the same, the delay of 724 days is condoned. Accordingly, the condone delay petition is ordered. Consequently, the petitions to set aside the abatement and to bring on record the legal representatives of the deceased second respondent are ordered.
