ORDER
This writ petition has been filed to direct the first respondent to pay pension arrears from the date of retirement ie., from February 2005 to January 2015 with 10% interest.

The short facts of the case are as follows.

The petitioner who had joined the service as conductor had retired from the service on 31.01.2005. Since the terminal benefits were not settled upon him, the petitioner had filed a writ petition in W.P.No.39434 of 2006 on the file of this Court. This Court, by an order dated 19.06.2012, was pleased to allow the said petition as follows: "15. In the matter, the writ petition is allowed, leaving the parties to bear their own costs. The respondents are directed to pay backwages to the petitioner for the period from 28.10.2002 to 21.01.2005, Gratuity, Provident Fund amount, Pension and other terminal benefits, to which, he is legally entitled to, within a period of twelve weeks from the date of receipt of a copy of this order."

The petitioner would submit that pursuant to the said order, he was paid the sanctioned pension from the month of February 2015. The backwages, Gratuity, Provident Fund were settled in the year 2014. Though, the petitioner had attained superannuation on 20.01.2005 and was entitled to pension from the month of February 2005, the respondents had sanctioned pension only from the month of February 2015. Therefore, the petitioner had sought for the arrears of pension for the period of February 2005 till January 2015. Since the respondents are not coming forward to dispose the same, the petitioner has filed this writ petition before this Court.

Heard the learned counsel on either side and perused the materials available on record.

In the order dated 19.06.2012 made in W.P.No.39434 of 2006, this Court has clearly observed that the petitioner is entitled to backwages for the period of 28.10.2002 to 21.01.2005 and also entitled to Gratuity, Provident Fund amount, Pension and other terminal benefits. However, the respondents for reasons best known to them, have sanctioned the pension
only from the month of February 2015, though the petitioner had retired from the service in the month of January 2005 and entitled to receive his pension from the month of February 2005.

In the light of the earlier order passed by this Court, the petitioner is entitled to pension from February 2005 to January 2015 and therefore, the arrears shall be calculated and settled to the petitioner within a period of two months from the date of receipt of a copy of this order. With the above directions, this writ petition is allowed as prayed for. No costs.
