WP.No.156 of 2017:Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus Calling for the records pertaining to Transfer Order dated 26.12.2016 issued by the 3rd respondent in proceedings No.T.IX.1/ 2016-EC-1 and quash the same and forbear the respondents from transferring the petitioner from Recruit Training Centre (RTC) CRPF Avadi to 85 Battalion CRPF Bijapur till he has acquired medically fit (SHAPE-I)

JUDGMENT
(Judgment of the court was made by HULUVADI G.RAMESH, J.) Heard the learned counsel appearing for the appellant and Mr.Su.Srinivasan, learned Assistant Solicitor General, who takes notice on behalf of the respondents.
2. It appears that the appellant/writ petitioner sought to cancel the impugned order transferring him from Recruit Training Centre (RTC), CRPF, Avadi to B5 Battalion, CRPF, Bijapur till he acquires medically fit (Shape-I), on the ground that he met with an accident. The order passed by the learned Single Judge declining to grant the relief is challenged in the present writ appeal.
3. Learned Assistant Solicitor General representing the respondents submitted that considering the physical condition of the appellant, he would be provided with appropriate job which would not lead to much strain to him, till he recovers.
4. In that view of the matter, we do not find anything to adjudicate in this appeal, rather, we feel that it is suffice to direct the respondents authorities to consider the case of the appellant/writ petitioner sympathetically and provide him alternative work in the place where he is already serving till 30th November 2017, so as to enable him to recover soon and the appellant shall join in the transferred place by 1st December 2017.
5. The writ appeal is disposed of accordingly. No costs. The connected miscellaneous petition is closed.
