Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed against the petitioner by this Honble court dated 09.05.2019 in Crl.MP.No.6543 of 2019 in Crl.RC.No.428 of 2019 on such terms and conditions the petitioner should appear before the learned III Metropolitan Magistrate, George Town,Chennai on the first working day of every week at 10.30 until further orders, pending disposal of the above criminal revision petition.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.PANNEERSELVAN, Advocate for the petitioner and of MR.K.PRABAKAR ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- Challenging the conviction and sentence imposed on the petitioner / accused by the Court below, the petitioner filed a petition in Crl.M.P.No.6543 of 2019 praying for suspension of sentence and by order dated 09.05.2019, this Court passed an order suspending the sentence. Now, the present petition has been filed to relax the condition imposed against the petitioner as regards appearance of the petitioner before the Court below. 2.The learned counsel for the petitioner has submitted that the petitioner is regularly complying with the conditions imposed by this Court without fail from 24.05.2019 to till date and hence, the condition imposed against the petitioner as regards appearance of the petitioner before the Court below, may be relaxed. The learned Additional Public Prosecutor has not seriously opposed the said submission.
3.Taking note of the above and also the facts and circumstances of the case, the condition imposed by this Court in Crl.M.P.No.6543 https://hcservices.ecourts.gov.in/hcservices/
of 2019 on 09.05.2019 directing the petitioner to appear before the Court below on the first working day of every week at 10.30 a.m., is hereby modified to the effect that the petitioner shall appear before the Court below on the first working day of every month at 10.30 a.m., until further orders.
4.This petition is ordered accordingly.
