Advocate (Crl.Side) in both the Ops ****** COMMON ORDER These criminal original petitions have been filed seeking to direct the learned Additional District JudgeI, Tindivanam, to conduct trial of the case in S.C.Nos.94 of 2005 & 215 of 2010 in pursuance of Crime No.178 & 179 of 2003 on the file of the respondent police on a day to day basis and to complete the proceedings.

The learned counsel appearing for the petitioner would submit that the cases are pending from the year 2005 & 2010 without any considerable progress and hence the petitioners seeks direction of this Court https://hcservices.ecourts.gov.in/hcservices/

to the learned Additional District Judge-I,Thindivanam to complete the trial in the cases in S.C.No.94 of 2005 & 215 of 2010 within the time to be fixed by this Court. The learned Government Advocate (Crl.Side) would submit that the case in S.C.No.94 of 2005 & 215 of 2010 are still pending.

Heard the learned counsel appearing on either side and perused the materials available on record. It is seen that the petitioner have sought for a direction to conduct trial in S.C.No.94 of 2005 and 215 of 2010 on day to day basis, since there is no considerable progress in the cases. The Government Advocate stated that the matters are still pending. Even though, these cases are pending from the year 2005 & 2010, prosecution has not taken any effective steps to conduct the cases and dispose of the same. Therefore this Court is inclined to issue direction to the trial Court as sought for by the petitioner.

In the result, the criminal original petition are allowed and the learned Additional District Judge - I, Thindivanam, is directed to post the cases in S.C.No.94 of 2005 & 215 of 2010 on a day to day basis and conduct trial on the same and dispose of the cases in accordance with law on or before 13.12.2019 and file a report on the same before this Court on 16.12.2019.
