Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus,directing the respondents 2 and 3 to send a revised proposal to the 1st respondent within time frame fixing revised pay with arrears as well as revised pension pay with arrears of the Petitioners w.e.f. 1.10.2010 on a par with her junior Mr.Manimaran as even ordered in W.P. No. 3001 of 2020 dated 10 / 8 / 2021 besides directing the 1st respondent to ratify such revised proposal and revised pension pay payable by the 4th respondent office, namely Accountant General (Accounts and Entitlement) within time frame. 1/7

O R D E R
The Writ Petition has been filed for the following reliefs:- "directing the respondents 2 and 3 to send a revised proposal to the 1st respondent within time frame fixing revised pay with arrears as well as revised pension pay with arrears of the Petitioners w.e.f. 1.10.2010 on a par with her junior Mr.Manimaran as even ordered in W.P. No. 3001 of 2020 dated 10 / 8 / 2021 besides directing the 1st respondent to ratify such revised proposal and revised pension pay payable by the 4th respondent office, namely Accountant General (Accounts and Entitlement) within time frame."
2. It is informed that in the light of the order passed in GO.(2D) No.189 dated 11.10.2023, the relief claimed by the petitioner has been complied with. The relevant paragraphs of the said Government Order are extracted hereunder as follows:- "8) Further, in respect of the remaining other individuals / writ petitioners in this case viz., Tvl./Tmt. R. Saraswathy & E. Abubacker and non-writ petitioners namely, Tvl. S. Simson, V. Desabandhu & G. Madhaiyan, 2/7
Deputy Agricultural Officer (Retired) the Director of Agriculture has not issued any orders rectifying their pay anomaly and therefore, requested the Government to issue necessary orders rectifying the pay anomaly of the individuals mentioned in the Annexure (Retired Deputy Agricultural Officers) on par with their junior Thiru P.T. Manimaran in addition to the proceedings issued individual vide 3rd read above, by fulfilling-the conditions stipulated in the Tamil Nadu Revised Scales of Pay Rules, 2009 in order to avert further legal proceedings.
9) The Government after careful examination of the proposals submitted by the Commissioner of Agriculture vide reference 11th read above, has decided to rectify the pay anomaly in respect of the individuals /writ petitioners mentioned in the Annexure on par with their junior Thiru P.T.Manimaran, Deputy Agricultural Officer (Retired) w.e.f. 01.01.2010. based on the earlier orders delivered by the Hon'ble High Court of Madras and its Madurai Bench, Government Orders referred under 4th to 10th read above.
10) Accordingly, in exercise of powers conferred 3/7
under Rule 5(2) of the Tamil Nadu Revised Scale of Pay Rules, 2009, the Government hereby ordered that the pay of Retired Deputy Agricultural Officers mentioned in the annexure appended with this Governmental Orders may be stepped up to Rs. 22,700/- (Basic Rs.18000+ G.P. Rs. 4700) in the pay scale of Rs.9300-34800+G.P. 4700 in the post of Deputy Agricultural Officer with effect from 01.01.2010 on par with that of their junior Thiru. P.T. Manimaran, Deputy Agricultural Officer (Retired) and subsequently, the proceedings of the Director of Agriculture ordered vide 3rd read above shall stands cancelled.
11) Based on the above orders, the Commissioner of Agriculture is directed to instruct the authorities concerned to re-fix the pay of the individuals on par with their junior as indicated in the Annexure to this order.
12) The Commissioner of Agriculture is directed to verify the genuineness of the names and other particulars indicated in the Annexure to this order and to extend the benefits ordered in respect of them accordingly, without any deviation/fault.

13) The Commissioner of Agriculture is also directed to issue necessary instructions to pay fixing authorities concerned to ensure the correctness of the Name, Designation, Date of Joining, calculation of monetary benefits and other relevant particulars of the individuals indicated in the Annexure to this order.
14) The Commissioner of Agriculture is further directed to send similar nature of pending proposals with regard to issuance of necessary orders towards rectification of pay anomaly in respect of retired personnel at Government level.
3. Therefore, no further orders are required to be passed in the above Writ Petition and accordingly, the Writ Petition stands closed. No costs. 16.12.2025 (shr) Index : Yes/No Speaking Order: Yes/No 5/7
