The petitioner seeks anticipatory bail in Crime No.309 of 2023 registered by the respondent police for the offences punishable under Section 379 of IPC.

2. It is stated that the two accused, had come on a scooty bike and had taken away the defacto complainant's mobile phone. It is further stated that A1 had been arrested and still in custody. There is one previous case against the petitioner. The said mobile phone had not been recovered.

3. The matter has been listed twice earlier when it was observed it would be that only to the advantage of the petitioner that the mobile phone is produced. There is no still recovery of the stolen property.

4. Taking all those factors into consideration, I am not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, the Criminal Original Petition seeking anticipatory bail stands dismissed.
