This Civil Miscellaneous Second Appeal has been filed to set aside the Judgment and Decree dated 04.12.2009 made in C.M.A.No.1 of 2008 on the file of the Additional District Court, Fast track Court No.II, Gobichettipalayam, Erode & District reversing the Judgment and decree dated 12.10.2007 made in E.A.No.340 of 2000 in E.P.No. 49 of 1995 in O.S.No. 63/1985 on the file of the Principal Sub Court, Gobichettipalayam Erode & District.

2. When the matter is listed today, it is reported by learned counsel appearing for the appellant as well as the respondent that both the appellant and the respondent are no more.
