ORDER

This Criminal Original Petition has been filed to quash FIR in Crime No.48 of 2014 on the file of the 1st respondent Police. 2.The learned counsel for the petitioners submitted that there was civil dispute between the the petitioners and the 2nd respondent which has been given in criminal colour and a case came to be registered against them under Section 420 IPC. He further submitted that during the pendency of investigation, the dispute between the petitioners and the 2nd respondent got resolved and compromise has been arrived and a joint compromise memo was filed to that effect before this Court and as well before the 1st respondent Police during the year 2015. https://hcservices.ecourts.gov.in/hcservices/

3.The learned Additional Public Prosecutor appearing for the 1st respondent submitted that the issues between them were resolved amicably and the offence under Section 420 IPC is a compoundable one. Recording the compromise, RCS notice in R.C.S.No.16 of 2015, dated 27.07.2015 served on the 2nd respondent and the same was filed before the learned Judicial Magistrate No.II, Pollachi. Thereafter, the learned Judicial Magistrate No.II, Pollachi has forwarded the notice to the 2nd respondent on 10.09.2015. The 2nd respondent appeared before the learned Judicial Magistrate No.II, Pollachi and admitted about the receipt of RCS notice and also the compromise entered between them. The 2nd respondent not aggrieved over the same. 4.Recording the above submissions, this Criminal Original Petition is closed.
