VENKATESAN, Advocate for the petitioner and of MR.M.J.VIJAYARAAGHAVAN, Advocate for the Respondent the court made the following order:- The petitioner/claimant has come forward with this petition seeking to permit him to withdraw the amount deposited by the respondent/appellant to the credit of the O.P.No.107 of 2010 on the file of the Motor Accident Claims Tribunal, V Court of Small Causes, Chennai.
2. Heard the learned counsel for the petitioner/claimant and learned counsel for the respondents.
3. Considering the facts and circumstances of the case, the petitioner/claimant is permitted to withdraw 40% of the amount lying in the deposit with proportionate interest.
4. Accordingly, this petition is allowed.
