(Crime No.306 of 2023) ... Respondent PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C., prayed to modify the condition that one of the surety must be a Government servant imposed on the petitioners in Crl.M.P.No.9542 of 2023 on the file of the Principal Sessions Judge, Villupuram, by an order dated 09.11.2023. .

For Petitioners : Mr. M.P.Yuvaraj For Respondent : Mr. R. Vinothraja Government Advocate (Crl. Side) 1/4

ORDER

This petition has been filed seeking modification of the order dated 09.11.2023 passed by the learned Principal Sessions Judge, Villupuram in Crl.M.P.No.9542 of 2023, wherein, while granting bail to the petitioners, the learned Principal Sessions Judge, Villupuram, had stated that they should each produce as surety one Government servant. 2.The offence involved is under Section 392 IPC and later altered to Section 395 IPC. I can visualize the difficulty in calling upon the public servant to stand as surety for the petitioners. 3.Taking all the factors into consideration and since primarily bail had been granted, that particular condition alone is modified to the effect that the petitioners shall produce two sureties each, out of which, one surety must be blood surety. Accordingly, this Criminal Original Petition is ordered. 29.01.2024 smv 2/4

To 1.The Principal Sessions Judge, Villupuram.

2.The The Inspector of Police, Marakkanam Police Station, Villupuram District.

3. The Public Prosecutor, High Court of Madras.
