This Civil Miscellaneous Petition is filed under Section 151 of the Code of Civil Procedure, 1908 praying to Stay the operation of the Decree dated

October 23, 2000 made in OS No.888 of 1993 on the file of the Additional District Munsif Court at Tiruvannamalai confirming the Judgment and Decree in AS No.134 of 2000 and 30 of 2001 dated December 10, 2002 on the file of the Principal District Judge Tiruvannamalai District pending disposal of the S.A. NO.935 of 2003.

2. The Civil Miscellaneous Petition in CMP No.8478 of 2003 in S.A. No.935 of 2003 has been filed under Section 151 of the Code of Civil Procedure, 1908 praying for a stay of the operation of the decree and judgment dated December 10, 2002 made in A.S. No.134 of 2000 on the file of the Principal District Judge, Tiruvannamalai, pending disposal of S.A. No.935 of 2003.

3. In this Civil Miscellaneous Petition, an order of interim stay was granted by this Court on 26.03.2003 for a period of three weeks only. Thereafter, the stay order was not extended further.

4. In view of the facts and circumstances of the case, and considering the long pendency of the Second Appeal, this Court is of the view that no useful purpose would be served by keeping this Civil Miscellaneous Petition pending. Accordingly, the Civil Miscellaneous Petition in CMP No.8478 of 2003 in S.A. No.935 of 2003 stands closed.
