This application is filed under Section 9 of the Arbitration and Conciliation Act seeking a direction to the respondents to furnish security to the tune Rs.6,33,676.15p, failing which, to order attachment of the properties, mentioned in the Schedule to the Judge's Summon.
2. Heard the learned counsel for the applicant.
3. This Court, vide order, dated 15.3.2016, ordered notice to the respondents. Mr.N.E.A.Dinesh, the learned counsel, who appeared on behalf of the first respondent on the last hearing date, reports 'no instructions'. Despite notice having been served on the second respondent, he has not chosen to appear either in person or through a counsel. The name of the second respondent is also printed in the cause list. Inspite of sufficient opportunity given to the respondents, no counter has been filed. Hence, there shall be an order of attachment of the immovable properties mentioned in the schedule to the Judges Summons. The application is ordered accordingly. 23.12.2016 msk
