ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.12.2025 for the alleged offence under Section 275, 123 of BNS r/w.24(1) of COTPA Act in Crime No.447 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner transported 80 kgs of banned Tobacco Products illegally to A1 from banagalore. Hence the compliant.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally three accused involved in this case, in which the petitioner is arrayed as A3 and identified as the supplier. He further submit that there are 7 previous case pending against the petitioner. Hence, he opposed to grant bail to the

petitioner.

5. Considering the manner in which the occurrence taken place and the fact that the petitioner has 7 previous cases, this Court is not inclined to grant bail to the petitioner.
