Prayer:Writ petition filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus, directing the respondents to consider the petitioner's representation dated 06.11.2017 and consequently, direct the Respondents to transfer the Patta to the property situate at Door No.9, Old Door No.3, Old Door No. 1A, IIIrd Street, Sowrashtra Nagar, Choolaimedu, Chennai - 600 094, comprised in S.No.25, Patta No.73, (Old Patta No.324) T.S.No.6, Block No.18 ( Old No.109, New No.100, Puliyur Village), Egmore Taluk, Chennai District measuring an extent of One Ground and 8 Sq.ft. or thereabouts, in the name of the Petitioner. Mr.B.Anandan, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioner seeks for a mandamus to direct the respondents to consider his representation dated 06.11.2017 and consequently, direct the respondents to transfer the Patta to the property situate at Door No.9, Old Door No.3, Old Door No. 1A, IIIrd Street, Sowrashtra Nagar, Choolaimedu, Chennai - 600 094, comprised in S.No.25, Patta No.73, (Old Patta No.324) T.S.No.6, https://hcservices.ecourts.gov.in/hcservices/

Block No.18 ( Old No.109, New No.100, Puliyur Village), Egmore Taluk, Chennai District measuring an extent of One Ground and 8 Sq.ft. or thereabouts, in the name of the Petitioner.

4. The grievance of the petitioner is that his request for transfer of patta in his name made as early as on 06.11.2017, has not been considered by the respondents so far.

5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the second respondent to consider and decide the same, in accordance with law. Therefore, without expressing any view on the merits of the matter, this writ petition is disposed of, only with a direction to the second respondent to consider the request of the petitioner to transfer of patta in his name in respect of the subject matter property and pass orders on merits and in accordance with law, also after considering the rival claimants, if any. Such exercise shall be done by the respondent within a period of four weeks from the date of receipt of a copy of this order.
