Respondent PRAYER: Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to pass a considered order on the application given by the petitioner on 23.03.2012 and consequential relief by way of direction to issue a patta in favour of the petitioner's namely Mr.R.Srinivasan pertaining to the property comprised in S.No.12/2, measuring an extent of 0.62 cents, Thazhambur Village, Chengalpet Taluk, Kancheepuram District. ORDER

This Writ Petition is filed to direct the respondent to pass a considered order on the application given by the petitioner on 23.03.2012 and the consequential relief by way of direction to issue a patta in favour of the petitioner's namely Mr.R.Srinivasan pertaining to the property comprised in S.No.12/2, measuring an extent of 0.62 cents, Thazhambur Village, Chengalpet Taluk, Kancheepuram District.

2. Heard both sides.

3. The petitioner has claimed that he was in possession and enjoyment of the lands at Thazhambur Village, Chengalpet Taluk, Kancheepuram District of an extent of 0.62 cents. He claimed that it was ancestral lands. It had not been cultivated properly because of insufficient water facility. He also paid necessary https://hcservices.ecourts.gov.in/hcservices/

fasli for Survey Number 12/2 and his name has also been entered in the records of Adangal and Chitta. But, the lands are categorized as "Nanjai Anadheenam". Therefore, the petitioner has sent a representation dated 23.03.2012, seeking patta to be issued in his name with respect to the said lands.

4. If the property is actually "Nanjai Anadheenam" lands, the Tahsildar may mention it to the petitioner, so that the petitioner can take further steps. However, the respondentTahsildar has not made any reply to the representation of the petitioner. The respondent-Tahsildar is directed to pass orders on the said representation dated 23.02.2012 in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. No costs.
