Respondents PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the 3rd respondent to entrust the investigation of the case in Crime No.114 of 2018 to the 4th respondent to conduct further investigation in accordance with law to secure the ends of justice. O R D E R

The grievance of the petitioner is that though the FIR came to be registered on 08.09.2018, there is no much progress in the investigation.

2.The learned Additional Public Prosecutor, on instructions, submitted that the investigation is still pending.

3.Though one year has lapsed since the registering of the FIR, the fact remains that the final report has not been filed, there has not been any effective progress in the investigation.

4.Nevertheless, it would not be appropriate to quash the FIR on that ground. If the 3rd respondent herein is directed to complete the investigation within stipulated time and such an investigation is directed to be monitored by a superior officer, the ends of justice would be secured. 5.In the light of the above observations, there shall be a direction to the 3rd respondent herein to complete the investigation and file a final report, as expeditiously as possible, in any event, within a period of six weeks from the date of receipt of a copy of this order. Such an investigation shall be monitored on day-to-day basis by the Deputy Superintendent of Police over the 3rd respondent jurisdiction. 6.Accordingly, this criminal original petition is disposed of.
