JUDGMENT

(Judgment of the Court was delivered by N.KIRUBAKARAN, J.) The above Appeal Suit has been filed against the Decree and Judgment passed by the Trial Court in O.S.No.175 of 2013 filed by the appellant/plaintiff, dismissing the suit.

2. When the matter is called today, the learned Counsel appearing for the appellant would submit that already memo of withdrawal has been filed by the appellant and therefore, he seeks to withdraw the Appeal Suit. The learned counsel for the respondents has also agreed for the same.

3. A perusal of the memo would reveal that the appellant sought for withdrawal of the Appeal Suit, as the matter has been settled out of the Court and the withdrawal memo was signed by the appellant and countersigned by the learned counsel for the appellant.

4. In view of the above, the Appeal Suit is dismissed as withdrawn. Consequently, connected Civil Miscellaneous Petition is closed. No costs.
