ORDER

Though this petition has been filed for early hearing, however, it is to be pointed out that in respect of matters relating to quashment, sufficient time ought to be granted to the respondents to file their counter and submit their arguments. Though in the present case, counter has been filed, however, the matter involves complex policy issues, the respondents seeks indulgence of this Court for further time to get appropriate instructions and place their arguments by engaging Senior Counsel.

2. Further, it is to be noted that the petitioner seeks to keep in abeyance the exemptions granted to airlines. When air safety and travel of passengers are taken into consideration, merely for the sake of the individual petitioner this Court cannot grant an immediate hearing, as the issue as aforesaid relates to passenger safety, who travel by air which is within the domain of the respondents. Therefore, the plea of the petitioner for fixing an early date for hearing the case cannot be granted. Though this Court can sympathise with the petitioner considering her medical ailment, but the safety of all the passengers cannot be jeopardized by rushing through the hearing by asking the respondents to place their submissions.

Further, it is to be pointed out that matters of yesteryears are pending in large numbers before this Court which is also urgent insofar as the respective petitioners are concerned of which there are very many matters, which is of grave public importance. Therefore, this Court cannot grant indulgence to all the individual cases, unless a grave urgency is shown, which is not evident in the present case.

4. Therefore, finding no merit in the present petition seeking early hearing, this W.M.P. No.994 of 2026 is dismissed. 12.01.2026 (3/3) vsi2 3/4
