O R D E R

The learned counsel appearing on behalf of the appellant made a submission that the issues between the parties had settled out of Court. The dues to the Bank had already been recovered in full.

2. In view of the said submission, no further adjudication is required in respect of the grounds raised in the civil miscellaneous

petition. Accordingly, the civil miscellaneous petition stands as disposed of as settled out of Court and consequently, A.S.SR.No.11335 of 2003 is closed. No costs.

3 . The Registry is directed to refund the Court fee by following the procedure contemplated under Section 69(A) of the Tamil Nadu Court Fees and Suits Valuation Act.
