Respondent This Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to consider the claim of the petitioners for promotion as Head Constable on par with their batch mates and from the date on which they were extended with such benefits of Head Constables on the basis of the representation dated 2.8.2016 followed by reminder dated 12.11.2016 and to grant all consequential benefits, both service and monetary forthwith.

O R D E R

The relief sought for in this writ petition is for a direction to direct the respondent to consider the claim of the petitioners for promotion as Head Constables on par with their batch mates and from the date on which they were extended with such benefits of Head Constables on the basis of the representation dated 2.8.2016 followed by reminder dated 12.11.2016.

The learned counsel appearing for the writ petitioner contended that the first writ petitioner was appointed on 31.10.1995 and the other petitioners, namely, 2nd, 3rd and 4th, were on 15.4.1997 as Grade-II Constables. Thereafter, all the petitioners were brought to Coimbatore City Motor Transport Wing of the respondent and promoted as Head Constables on 10.5.2010, 10.1.2010 and 1.5.2012 respectively.

3. The claim of the writ petitioners is that the Grade-II Constables appointed subsequent to the appointment of the writ petitioners are further promoted to the post of Sub-Inspector and in this regard, the respondent has not given due weightage to the seniority of the writ petitioners. In this regard, the writ petitioners submitted representations to the respondent on 2.8.2016 and 12.11.2016 respectively.

Without going into the merits and demerits of the matter, this Court is inclined to direct the respondent to consider the representations submitted by the writ petitioners on 2.8.2016 and 12.11.2016 respectively and pass orders on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. The writ petitioners are directed to enclose the copy of the representations along with the order passed in this writ petition. Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs.
