The petitioner, who was arrested and remanded to judicial custody on 14.10.2023 for the offences punishable under Section 4 of POCSO Act in Crime No.4 of 2023, seeks bail.

2.The learned counsel for the petitioner stated that the petitioner and the defacto complainant are neighbours and there was an existing dispute between the two of them and consequent to which, a false complaint had been given that the victim child / daughter of the defacto complainant had been sexually assaulted by the petitioner. It is also contended that the wife of the petitioner had conceived and is in advance stage of pregnancy. It is also contended that the petitioner had been in judicial custody for considerable period of time. 3.The learned Government Advocate (Criminal Side) for the respondent, however, forwarded the statement of the victim child recorded under Section 164(5) Cr.P.C.

smv 4.A perusal of the same shows that the petitioner would have to contest the case on merits and to prove his innocence of the alleged offences.
