By Order dated 17.03.2016, twelve months time was granted from 01.04.2016 to vacate the shop and to hand over the possession to the landlord. The said period expires by 31.03.2017. 3.

At this stage, the learned counsel for the tenant would submit that because of the supervening circumstances prevailing in the place of the shop, de-monetisation and because of the untimely death of his mother, the tenant is not able to get the alternative premises and therefore, in order to vacate the tenanted premises, some more time is required. 4.

The learned counsel for the landlord objected stating that already one year time had been granted and already execution petition is pending and therefore, this Court need not consider the request for any extension.

After parties negotiating between themselves, the landlord reluctantly agreed for two months time and the tenant insisted for four months time. In order to bridge the gap, this Court is inclined to extend time to vacate the premises for a period of three months i.e., from 01.04.2017 till 30.06.2017, subject to the condition that (a) no further request for extension of time shall be entertained (b) rent for the period from 01.04.2017 till 30.06.2017 shall be paid in advance i.e., within a period of one week from today by way of Demand Draft, failing which, this order shall cease to be operative.
