Prayer:PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 04.4.2018 and thereby restraining the respondents from in any way reopening the TASMAC bar and outlet No.8726 in door No.773/4, Balaji Nagar, Thirumullaivayal, Chennai. ORDER

Mr.P.Arumugharajan, learned Standing Counsel accepts notice for respondents 1 and 3. Mr.R.P.Pratap Singh, learned Government Advocate accepts notice for the second respondent. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner seeks a direction to the respondents to forbear them from reopening the TASMAC bar and outlet No.8726 in door No.773/4, Balaji Nagar, Thirumullaivayal, Chennai. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Standing Counsel appearing for respondents 1 and 3 submits that the respondents have given an undertaking before the Hon'ble First Bench of this Court that they will not relocate the shops in the old location, which were initially closed on the ground that they were abutting national highway and that they will await the orders from the Hon'ble First Bench.

4. In the light of the said submission, the petitioner need not have any apprehension that the shop in question will be reopened in the same location, as the matter is subjudice before the Hon'ble First Bench. The respondents are directed to proceed further in the matter after the orders are passed by the Hon'ble First Bench.

5. With the above observation and direction, the writ petition is disposed of. No costs. Consequently, the connected WMP is closed.
