The petitioner seeks bail in S.C.No.419 of 2014, now pending trial before the IV Additional Sessions Judge, Chennai. Originally, Crime No.776 of 2013 had been registered for the offences under Sections 341, 294(b), 324, 336, 427, 397, 307 and 506(ii) of IPC.
2.Originally, a Non-bailable warrant was issued on 02.09.2021 and it was executed on 31.08.2023. The prosecution had examined all their witnesses and the learned counsel for the petitioner/accused have now filed an application seeking to recall four of the witnesses and thereafter, the trial process itself would completed.
3.The learned counsel for the petitioner stated that he has a mother to look after who is mentally challenged. It is for that reason a direction is given to the IV Additional Sessions Judge, Chennai, that if the learned counsel for the petitioner/accused cross-examine all the witnesses who have been recalled, and 1/3
thereafter, if they also come forward for advance arguments, immediately after the arguments are advanced, without any delay, to pronounce judgments. 4.With the above observations, this Criminal Original Petition is dismissed.
