ORDER
Apprehending arrest in connection with Crime No. 838 of 2024 registered for the offences punishable under Section 309(4) of BNS, the present petition has been filed seeking anticipatory bail. 1/4
2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.
3. The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner, along with other accused, way laid the defacto complainant and demanded money. When the defacto complainant refused, the petitioner, along with other accused, assaulted the defacto complainant on his face, snatched his cell phone and took Rs.1,300/- in cash at knife point. He further submitted that the petitioner has two previous cases pending against him.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent Police and perused the materials available on record
5. Considering the gravity of offence committed by the petitioner, the petitioner's criminal antecedents and the fact that the petitioner has two previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
