The petitioner, who was arrested and remanded to judicial custody on 31.10.2025, for the offence punishable under Sections 310(2) of BNS in Crime No.341 of 2025, registered on the file of the respondent, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joining hands with other accused hatched conspiracy to rob money under the pretext of sale of old gold for lower price, had cheated the defacto complainant to the tune of Rs.50,00,000/-. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is not aware of the criminal conspiracy and prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that investigation in this case is pending and further submitted that out of the total cheated amount of of Rs.50,00,000/- only Rs.2,00,000/- lakhs was recovered from the petitioner and the main accused in this case is still absconding. He further submitted that this Court has earlier dismissed the bail petition of the petitioner in Crl.O.P.No.32018 of 2025 on 24.11.2025. Hence, he opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and the fact that only Rs.2,00,000/- lakhs was recovered and the main accused in this case is 2/4

still absconding and this Court has earlier dismissed the bail petition of the petitioner in Crl.O.P.No.32018 of 2025 on 24.11.2025, this Court is not inclined to re-visit the earlier order.
