The Second Appeal is filed under Section 100 of CPC against the judgment and decree dated 28.09.2001 made in AS.No.236 of 2000, on the file of Principal District and Sessions Judge, Coimbatore confirming the judgment and decree dated 27.03.2000 made in OS.No.16 of 1975 passed by the learned District Munsif, Mettupalayam.

JUDGMENT

This second appeal is filed against the judgment and decree dated 28.09.2001 made in AS.No.236 of 2000, on the file of Principal District and Sessions Judge, Coimbatore confirming the judgment and decree dated 27.03.2000 made in OS.No.16 of 1975 passed by the learned District Munsif, Mettupalayam. 2.The learned counsel appearing for the appellant submitted that the sole respondent died long back.

3. Though this Court had given enough time to take steps to implead the legal heirs of the sole respondent, the appellants failed to take steps to implead the legal heirs of the sole respondent. Therefore, this second appeal is liable to be https://hcservices.ecourts.gov.in/hcservices/

dismissed as abated as against the sole respondent. 4.Consequently, this second appeal is dismissed as abated. No costs.
