Earlier, on 23.01.2019, this Court had passed an order prohibiting the Garnishees from disbursing the amounts to the extent of claim made in respective applications to the respondents 1 and 2. Subsequently, the applicant has impleaded the fourth respondent, with whom the monies are available, as per the order passed in A.Nos.1521 to 1524 and 1526 of 2019 dated 27.02.2019. In the mean while, an award has also been passed on 29.03.2019. It is stated that the monies are available with the fourth respondent/Garnishee.

Pending the application, additional affidavits dated 04.11.2019 have been filed by the learned counsel for the applicant stating that vehicles were repossessed by the applicant and the same were subsequently sold on 31.08.2019, 31.08.2019, 31.08.2019, 27.09.2019 and 31.08.2019 for Rs.11,75,000/-, Rs.11,75,000/-, Rs.11,75,000/-, Rs.7,35,000/- and Rs.11,75,000/- respectively. After giving credit to the sale consideration, sums of Rs.2,13,095/-, Rs.2,28,857/-, Rs.2,08,736/-, Rs.6,44,973/- and Rs.2,10,016/- respectively are outstanding as on 04.11.2019. Hence, the learned counsel for the applicant prays for an order to deposit the said amount.

3. In view of the above, the respondents 3 and 4 / Garnishees are directed to deposit the monies due and payable to the respondents 1 and 2 to the extent of the reduced claim made to the credit of the respective applications.
4. Accordingly, the applications are closed. The applicant is directed to communicate the order as well as the affidavit to the Garnishees.
