... Respondents PRAYER: Appeal is filed under Clause 15 of the Letters Patent, praying to set aside the order of the learned Judge dated 17.03.2015 in

W.P.No.1574 of 2014 in so far dismissing the claim of the appellant beyond the period of three years.

For Appellant : Mr.K.K.Ram Siddhartha for M/s.Roa and Reddy For Respondents : Mr.A.M.Ayyadurai Government Advocate for R1 Mr.C.K.Chandrasekar for R2 JUDGEMENT (Judgement of this Court was delivered by M.S.RAMESH.J) Pending the Writ Appeal, the appellant / Union and the second respondent / Management have entered into a settlement dated 19.06.2024 under Section 12(3) of the Industrial Disputes Act, 1947. As per clause 23(g) of the settlement, the appellant / Union had agreed to withdraw the claim in Writ Appeal No.941 of 2015, which clause reads as follows: "23. FINALISATION OF CHARTER OF DEMANDS g) The Union /Workmen agrees and reiterate that they will not claim the Minimum Wages claim before the Authority DCL II even if the union won the condonation

of delay in W.A.941/15 & M.P.No.1/15 in the Madras High Court. And the union and workmen agreed to withdraw the said claim as the matter shall be treated as mutually settled and closed, and there will not be any matter for litigation in view of this settlement."

2. In view of the aforesaid mutually agreed terms between the parties, this Writ Appeal stands closed. No Costs. Consequently, connected miscellaneous petition is closed.
