ORDER

The petitioners herein apprehending arrest for the alleged offence under Sections 191(2), 127(7), 308(2), 115(2) & 351(2) of BNS, 2023 (Under Sections 147, 347, 384, 323 & 506(ii) of IPC) in Crime No.382 of 2025, on the file of the respondent police seek anticipatory bail.

The allegation against the petitioners is that the petitioners joining hands with the other accused involved in forging the defacto complainant's signature for the purpose of re-conveying the land in favour of one Ravi, who is the father of A1. It is further alleged that, the defacto complainant came to know about these facts, he lodged the complaint.

3. The learned counsel for the petitioners submitted that the petitioners have not involved in the said allegations. Further, he submitted that the coaccused were arrested and subsequently released on bail by this Court. He further submitted that the petitioners have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the investigation in this case is pending. She

further submitted that the co-accused 1 and 3 were already granted bail by this Court in Crl.O.P.No.35376 of 2025 dated 26.12.2025 and the second accused was granted anticipatory bail in Crl.O.P.No.35621 of 2025, dated 07.01.2026. However, she opposed for grant anticipatory bail to the petitioners.

Considering the nature of the allegations and the fact that the coaccused were already granted bail by this Court in Crl.O.P.No.35376 of 2025 dated 26.12.2025 and granted anticipatory bail to the second accused in Crl.O.P.No.35621 of 2025, dated 07.01.2026, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy made ready, before the learned Judicial Magistrate No.1, Thirupattur, on condition that the petitioners shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions:

(a) If the petitioners fails to surrender before the concerned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;

(b) The sureties shall affix his photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;

(c) The petitioners shall report before the respondent police everyday at 10.30 a.m., for a period of three weeks and thereafter, as and when required for interrogation; (d) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];

(e) If the petitioners thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act.
