For Petitioner(s) : M/s. Priyanka R.

ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B) of NDPS Act and 25(1A) of Arms Act in Crime No.349 of 2024, on the file of the respondent police, seeks anticipatory bail. 2.

The case of the prosecution is that, based on a secret information, the respondent police went to the spot and found that the accused persons were found in possession of 2.143 kgs of ganja and sickles; and that during investigation, A1 confessed that the petitioner was also involved in the aforesaid offence. Hence, this case. 3.

Learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case, based on the confession of the co-accused; that the petitioner had never committed any offence as alleged by the prosecution; and that the petitioner is ready to produce solvent sureties and to abide by any conditions that may be imposed by this Court and also undertake to appear 2/6

and to co-operate for the investigation, and prayed for anticipatory bail to the petitioner.

4.

Learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and on instruction submitted that the petitioner has been arrayed as A8 in this case; that the petitioner has eight previous cases; and that the investigation is pending, hence opposed for grant of anticipatory bail to the petitioner. 5.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record.

6.

Taking note of the facts and circumstances of the case, considering the nature of allegation against the petitioner, submissions made by the learned counsels on either side, the fact that the petitioner was implicated only on the confession of the co-accused, the contraband was seized from the co-accused, the petitioner is on bail in all the other cases and since custodial interrogation is not required for the purpose of 3/6

investigation, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

7.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate II Court, Coimbatore District on condition that the petitioner shall execute a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that:
