Application No. 4967 of 2012 has been filed by the applicant to condone the delay of 1879 days in filing the application to set aside the abatement caused due to the death of the fifth respondent, Application No.4968 of 2012 has been filed by the applicant to set aside the abatement caused due to the death of the fifth respondent and Application No. 4966 of 2012 has been filed by the applicant to bring on record the proposed respondents 7 to 9 herein as the legal representatives of the deceased fifth respondent as respondents 8 to 10 in the main petition.

2. The proposed respondents have been duly served. The ninth respondent is represented by a learned counsel and the name of the respondents 7 and 8 have been printed in the cause list today. There is no representation of the side of the 9th respondent. Till date, no one has entered appearance on behalf of the respondents 7 and 8.

3. This Court is satisfied with the reasons contained in the affidavit filed in support of these applications. Accordingly, these applications are allowed as prayed for.

4. The applicant/petitioner is directed to carry out the amendment and serve

the amended copy of the petition on the respective learned counsels appearing for the respective respondents.

5. Post the matter on 12.01.2022.
