PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to issue direction directing the 2nd respondent not to harass the petitioner on the 3rd respondent complaint pending on his file.

ORDER

This Criminal Original Petition has been filed to issue direction to the 2nd respondent not to harass the petitioner on the complaint of the 3rd respondent pending on the file of the second respondent.

2.The contention of the petitioner is that the petitioner is a landlady and the third respondent herein entered into a lease agreement with the petitioner.

The lease amount is Rs.27,00,000/-. The third respondent immediately wanted to vacate the premises and return of the lease amount but, the petitioner was unable to pay the same immediately, for which, the third respondent lodged complaint and the respondent police is pressurising the petitioner to give back the lease amount which caused harassment, hence, the above petition. 3.The learned Additional Public Prosecutor submits that the https://hcservices.ecourts.gov.in/hcservices/

petitioner had received a huge sum as lease amount i.e., Rs.27,00,000/- from the third respondent and now forcing the third respondent to vacate the premises and not returning the lease amount.

4.The learned counsel for the petitioner submits that the lease amount would be repaid expeditiously within a period of thirty days. In the event of failure of payment within 30 days necessary action can be taken against her. The Additional Public Prosecutor is reminded that in the event of the petitioner committing the offence of cheating, appropriate action can be taken.

5.The learned counsel for the petitioner though submits that the petitioner had undergone surgery, there are no medical records to confirm the same. This defence is taken only to evade payment. At this stage, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition.

6.In view of the permission sought, this criminal original petition is dismissed as withdrawn.
