This Criminal Original Petition is listed today under the caption ''for being mentioned'' at the instance of the respondent/complainant/Party-in-Person. 2.The respondent/complainant/Party-in-Person appeared before this Court today and submitted that the submissions made by the petitioners before this Court in the Criminal Original Petition on 27.01.2022 with regard to modification of the condition imposed on them are not correct. The petitioners had given a wrong calculation that they had paid Rs.9.2 Crores so far. Considering the fact that the respondent had received a sum of Rs.8.74 Crores, this Court, vide order dated 27.01.2022, directed the petitioners to pay 20% of Rs.1.26 Crores. The respondent has produced statement of accounts to show that the remaining amount is much more.
3.Considering the submission that statutory appeal is pending, this Court had modified the condition, directing the petitioners to deposit a sum of Rs.25 Lakhs within 15 days from the date of the order or normal functioning of the Court, before the trial Court.

4.The respondent/complainant/Party-in-Person submits that even the petitioners have not deposited Rs.25 Lakhs as directed by this Court. The learned counsel for the petitioners rebutted the same stating that on 10.02.2022, the petitioners have deposited Rs.25 Lakhs before the Metropolitan Magistrate, FTC-1, Egmore @ Allikulam, Chennai.
5.Considering the above said submissions, the Metropolitan Magistrate, FTC-1, Egmore @ Allikulam, Chennai, is hereby directed to return Rs.25 Lakhs to the respondent/complainant, dispensing notice to the petitioners herein, on an application by the respondent, of course on an undertaking affidavit, subject to outcome of the appeal in C.A.No.199 of 2021 pending before the Sessions Court. It is made clear that the observations made by this Court, vide order dated 27.01.2022, in Crl.O.P.No.1441 of 2022, are only for the purpose of disposal of the above petition and the lower appellate Court shall dispose the appeal uninfluenced by the observations made in the said order, in a dispassionate manner, in accordance with law. 08.07.2022 Index : Yes/No smn2 M.NIRMAL KUMAR, J.
