This Writ Petition has been filed to issue a Writ of Certiorarified Mandamus to call for the rejection order dated 06.01.2025 passed by the second respondent and quash the same and consequently, direct the respondents to permit the petitioner to conduct the Pongal Thiruvizha on 13.01.2025 or any other date fixed by this Court at (1) Glass Factory Road, Ambedkar Nagar and (2) Bharati Nagar, Korukuppet Main Road, Chennai-21.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and perused the materials available on record.
3. Learned counsel for the petitioner submitted that the petitioner has given representation dated 02.01.2025 before the third respondent police to grant permission to conduct Pongal festival. The second respondent rejected the petitioner's representation dated 02.01.2025. Hence, the petition.
4. It is submitted by the learned Additional Public Prosecutor that the petitioner's said representation was rejected on the ground that said place is not a permitted and fit place for conducting Pongal festival. If permission is granted to the petitioner to conduct Pongal festival at the abovesaid place, it will create inconvenience/disturbance to the general public and traffic. The respondents have also suggested some other places in the very same area to celebrate Pongal festival. If the petitioner chooses any one of those places to conduct Pongal Festival, the petitioner's representation would be considered and orders will be passed.
5. In view of the above submission of the learned Additional Public Prosecutor, if the petitioner chooses any one of the places, as suggested by the respondents police, to conduct Pongal Festival, the second respondent is directed to reconsider the order dated 06.01.2025 (impugned order) and pass appropriate orders.
6. With the abovesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
