ORDER
The petitioner has filed this Writ Petition seeking for quashment of the impugned order dated 19.03.2013 passed by the third respondent.
2. The brief facts of the case are that the petitioner was appointed as an Assistant in the respondent company on 29.01.1987 and, through successive promotions, he was elevated to the posted of Deputy Manager on 10.10.2007. While so, the petitioner was served with a Charge Memo dated 31.08.2010 under Rule 25 of the General Insurance (Conduct, Discipline and Appeal) Rules alleging certain irregularities relating to availing and settlement of advances, including LTS and transfer advances. The petitioner submitted his detailed explanation on 29.11.2010 denying the allegations. Despite the same, the third respondent passed the impugned order dated 19.03.2013 imposing punishment. Aggrieved by the same, the petitioner preferred an appeal before the Appellate Authority on 16.04.2013. However, even before the disposal of the appeal, the second respondent proceed to implement the impugned order vide proceeding dated 15.04.2013. Hence the petitioner has filed the present Writ Petition.
3. Heard both sides and perused the records.
4. It is seen the petitioner has filed the present Writ Petition while simultaneously preferring an appeal before the Appellate Authority. When an alternative remedy has already been availed, the cause in the present Writ Petition does not survive.
5. Accordingly, this Writ Petition stands disposed of. No costs. K.SURENDER, J.
